Actually he's talking about the legality of handing over evidence in their possession. The casino is not obligated to keep that video private as there is no assumption of privacy in their elevator. I admit I'm no NJ law expert but that's the way I read the AG's comments.

I think it's absolutely clear that somebody in the NFL saw the footage. Whether or not it climbed all the way up the pole to the commissioner or other high level executives—or whether they specifically worked to maintain some level of plausible deniability—remains to be seen. The NFL has an enormous security department made up of ex cops and FBI guys and stuff like that. They are also insane control freaks that will stop at nothing to protect their brand. There is a 100% possibility that NFL execs, and likely Goodell himself saw the video.
