Someone else mentioned this (above). Furman v. Georgia was also in 1972, so did California overturn the death penalty because the U.S. Supreme invalidated every state’s death penalty, or did they do it before the Furman decision?
Was it because “California outlawed it,” or was it because the U.S. Supreme Court overturned the death penalty on 8th Amendment grounds? Furman v. Georgia, no? I only ask because both happened in 1972.
