To my knowledge, there is no case yet....if they decided to make a case, say in the U.S. about copies of the game sold that include their patented work to U.S. customers. Then it most certainly would be the U.S. patent it is judged by.

That’s not necessarily true. They could file suit in multiple countries, not unlike the patent battle we’ve seen over the last 10 years between Apple and Samsung.
