Harvey Weinstein’s case alone disproves your theory. Powerful people, having more responsibility to society than commoners, are often punished more severely than what their standalone crimes call for. It’s the “breach of public trust” doctrine.

I guess the theory goes that they control certain legal and law enforcement avenues through which prosecution or other punitive measures must flow. As for the elections, I believe they say that illegal voters are the ones taking the risk, if there is any risk to voting whilst not being a citizen in the first place.
