Pirated? Part of the agreement (signed by both parts) with Xerox was that Apple could freely re-write Xerox' OS, if they succeed to recreate it they could use it freely.
Actually, at the time Apple made a signed agreement with Xerox about that OS. Xerox didn't give Apple their code, but Apple engineers could see it and try to re-write it freely.
