    You’re assuming he saw the “downed rider.” If he passed the rider at all (he could have entered the interstate after the rider bailed out), he may not have noticed the rider, or, might have seen a guy but no bike and not had time at 65mph to figure out what was going on, especially if the guy was standing or walking.

    The safer thing to do is roll along slightly behind with the hazard lights on to warn other drivers. The damage is already done to the bike. No sense in adding vehicle damage as well.
