Oh ok, I didn't realize that there wasn't any leeway between 1 beer and not being able to stand up. No middle ground there at all.

I was taking your sentiment to a logical extreme. I did not claim that you thought this.

"well, you can get men to stop raping people."

Yes it obviously is. What you (willfully or otherwise) ignore is that A. There are varying degrees of intoxication, both in the way people exhibit being intoxicated and in how much it takes. Everyone who's intoxicated doesn't lose the ability to stand up. If that was the case I think that would be pretty convincing

No it's just that you understand nothing about law. Saying that "education" is the way to stopping rapes sounds good, but it is not what is even being discussed here. It's about the problem juries have assessing the burden of proof. You are so off base here. It's not a human right, normal, and frankly shouldn't be

That could be said for much of this website.

No one did that. You just can't read apparently.

"And a cornerstone of law enforcement, unfortunately, is guilty until proven innocent. Everything is geared that way, from which leads get chased to interrogation techniques."

"Because someone is always going to get hurt. Better it be a tiny number of men who showed questionable judgment by having sex with someone drunk enough that this could ever be an issue, than the huge number of women who are raped while drunk, often by someone who deliberately gave her more alcohol than she was

What a stupid statement

"Educate jurors about the psychology of victimhood"

Are you mentally ill?

WHAT?

untrue on like...3 counts I guess? That's not how the law, or reality works.

No one is saying that rapists aren't responsible for what they do. Going around blackout drunk unable to remember what you've been doing is, in general, not a great way to live your life. Men or women. Having a few drinks does not = blacking out and being unable to remember anything you did.

Thank you. It's not normal human behavior to go around blacking out all the time. Doesn't mean they deserve it etc etc, but it is a reality.

A. Whether rape is a crime or not is not what is being discussed. B. If both parties are drunk then are you assuming the man is automatically the rapist? The grey line between not able to drive and not able to consent to sex is for most people prettttty huge.

"What if there is physical evidence? What if there rapist has criminal history? For the judge that make the comment that didn't matter."

This kind of shit is why people don't take the people on this website seriously. Grow the fuck up.

No, i'm not for the death penalty, and i'm not sure how this parallels this in any way. I also disagree that "most if not all laws end up inadvertently throwing someone under the bus". That is absurd.
