“Frivolous” implies that they knew they had no case. That doesn’t seem to match the facts. The theater wouldn’t communicate with them outside of court, so there was no way to know that there wasn’t a provable case of negligence. Losing a case does not automatically mean that you had no grounds for pursuing it.

This is precisely why I think there should be a gun insurance system, modeled on car insurance. If you go on a fucking rampage and murder a bunch of people, then at least your gun insurance would pay their hospital and burial cost.

Nonetheless, Cinemark has enough money and enough accountants that they can literally write off the entire amount. The victims and their families won't get any kind of tax break, and most would not be able to pay their portion in any case. This is ridiculous on every level.
