Don’t recall Vader being based on Marvel villains but rather Japanese characters.

They can’t atm as he’s been established as male in video/motion picture canon via Rebels and as far as I know that follows the core canon. I agree this would have been a cool move, it’s just something they would have needed to do from the start of the new canon.
