Yeah, see, you don't get to arrest people just because they've been in trouble before. You still have to have evidence, probable cause, etc. Really, despite what they get away with, the police do not in fact have legal authority to do just whatever the heck they want to.

Assuming the accusations are true, the important part of this trial will be the sentencing. While it shouldn't matter, it probably will. Who knows? Maybe the judge lost money to Bernie Madoff and will jump at the change to skewer a finance guy.
