You’re right, but if you read the opinion, it does not close out successful litigation in the future, and part of the reasoning relies on timeliness of the claim.

Well, Jeep had a successful IP infringement claim against Hummer a few years ago over the 7-slot grille. Not sure if it was copyright or trademark (probably trademark in that case).
