It depends. If Nintendo went to the developers and paid them to put their games on this system, it could be a one time charge and no profits from sales would go to the developers. Alternatively, it could work similar to how Nintendo normally publishes games which would fit your description. More than likely though,

Sometimes license issues can pop up for their own games. Earthbound being released for the Wii U comes to mind. If I remember correctly they had to change it up to remove a song in the game they no longer had the rights to or something like that.

Yet Nintendo is under no obligation to offer a better product than pirates, which is almost impossible. By law however people are obligated to not pirate. However if you do not care about things like the law and morals than my argument is pretty much moot.

Strangely enough sometimes license issues can pop up on their own IP’s. This is something that happened with Earthbound I believe when they brought it over to the Wii U.

Licensing issues I’m guessing. This is pretty much no different than those plug and play Atari, Sega, etc. controllers you find at Wal-Mart. Seems like a cool idea but a bit pricey. Would be more inclined to get this if it was say $20.
