As the owner of an ebike that is in many ways more similar to an actual moped than a 49cc Vespa, but in no way similarly regulated, the absurdity and stupidity of it all is definitely not lost on me.

Yeah it drives me crazy too, the most annoying thing is that it legally classifies most 2 wheeled vehicles that cannot exceed 35mph in many states. Even those without pedals. Its worse in Europe they call any 2 wheeler without a manual clutch a moped.

Where I live it’s written into the law and it also drives me crazy. But I’ve learned to accept it.

SC resident here. I believe our DMV differentiates based on engine displacement. 50 cc and under get special treatment as mopeds, anything over that gets lumped in with motorcycles. I believe there are some rules about power output and/or top speed as well.

Moped is a legal term in many states defining a motorized two wheeled vehicle with a top speed under 35 mph and an engine displacement under 50 cc (not sure how that legally translates to EVs, but anyway...). Operating a moped (at least where I live) requires a driver’s license but not a motorcycle endorsement. I
