I think instead we will have limited liability like commercial airplane crashes.  This would ensure the technology could be used.

This track is terrible for $20k. If I had 20k, my track would be much bigger so that the cars could actually take the correct lines around the corners. In the track above, the cars take idiotic lines that make it much less realistic (for a slot car track, at least!)

True, but remember that wild acceleration is rarely used by the EV driver. 99% of the time, the car is driven normally, and thus vastly outperforms an ICE engine on environmental grounds.
