Yeah, owners getting tips is definitely illegal. I just noticed four or five replies where servers or former servers mentioned tipping out the kitchen staff. I just don't believe it happens statistically that often, if the number of replies is correlated to the general population.

I've worked in restaurants for 15 years, and the only place I ever worked in where the kitchen staff got a "tip out" was a chef-owned restaurant where the owners also got "tipped
