I'm sorry that you find the roots of California's rape by deception law to be ridiculous, but it is an old hang-over law that has it's roots int he idea that a wife must consent to sex with her husband. Sorry, but facts. (I'm not saying that is good, just that it is.)

I don't think this would count as rape in any U.S. jurisdiction, even the ones that weakly recognize rape by deception. (But I could be wrong.)
