We would at least be able to prove that we don’t know how to activate thwir powers. But could we definitively state that they don't have said power just because we don't know how to activate it?

How can you claim unequivocally that they don’t if you haven’t tested them? We knew the Earth was flat. We knew that leeching blood out of a sick person would make them healthy, we knew aliens dont exist. Yet here we are.

Thanks :D that was my point. One can’t prove they don’t have magical properties. The best one could do is exhaust all ideas for proving they do. But then someone else will come up with something else to try. 

How do you prove, scientifically, that they don’t?

Ohh, that is a good point. I had sort of assumed the former, but could have gone either way.

Yeah, when I heard about this I was disappointed that the judge didn't immediately call him on his BS, charge him the max possible fine, etc and then contact the local doctors ethics office.
