Road rage includes well more than shooting the finger. Hell, looking up road rage-related laws in Virginia, I found a recent story about a couple in Virginia Beach whose encounter with another driver ended with them hitting him with their car and stabbing him.

I don’t see how road rage would be considered a mitigating factor. If anything it adds to the charges they can stick him with in addition to murder.
