As I understand it, the threat is assault. Physical harm is battery. So, ‘assault with a deadly weapon’ doesn’t mean you caused harm, it means you threatened harm.

Presenting a threat to initiate physical harm is the legal definition of assault, pepper spraying someone is an appropriate reaction to that. I’m fairly certain that a full list of Leto’s antics will reveal instances where he met the legal definition of assault.
