The victim doesn’t press charges, the DA does. And it looks like they will.

They’re charging him anyway. The fact that the victim of an incident chooses not to press charges doesn’t actually stop the police and the DA from doing so.

Thank you. I just shake my head when people think that the victim has the option of giving the legal system permission if they would proceed with criminal charges. Kinda not in the hands of citizens....

‘Pressing charges’ is not needed in this case. The DA can choose to prosecute based on evidence provided, regardless if the driver cooperates.
