Actually I'd say it's more like assault with a deadly weapon. You may not intend for anyone to get shot, but putting a gun in someone's face is a crime in itself in the USA. With a harsh penalty as well. Attempted murder is for when you actually intend for the person to die but fail.

There's just too many reasons not to go digital on Nintendo. I wish they would wake up already.
