Actually I'd say it's more like assault with a deadly weapon. You may not intend for anyone to get shot, but putting a gun in someone's face is a crime in itself in the USA. With a harsh penalty as well. Attempted murder is for when you actually intend for the person to die but fail.

There's just too many reasons not to go digital on Nintendo. I wish they would wake up already. The only things they have going are instant gratification (to the extent nintendo's network can be considered instant) and the minor convenience of not carrying an extra cart. Doesn't really outweigh waiting two days on
