Yes they would have if they ever intended to go to trial, but as I said there is a reason it never went to trial and that is they would have lost their ass off. The same reason GM will settle or hide behind their bankruptcy. Paying for extra lawyers will not come close to 1.3 billion.
I don't think you understand that huge corporations have lawyers on the payroll. Also, by the time they got to a point where they could settle the extra little bit for an actual trial is pittance compared to 1.3 billion. Trust me there is a reason they settled, just as GM will do.
