I wouldn't say it's Tesla's fault. Lotus ships gliders over with basically everything assembled and Tesla just drops in the battery pack, motor, power electronics. If it's something Tesla did on their side, it shouldn't affect any Lotus models since Tesla never touches Lotus's cars.

The argument made for the BMW vs Chinese X5 clone seemed to be that the clone was so much cheaper that no one would mistaken one for the other, if I remember correctly. I think it was tried at an Italian court or something. The same argument might apply here.

I think he has correct the technical points down on why Tesla didn't build an EREV. The question was "What is your feelings about the range-extender concept of the Chevy Volt and why have you not considered it it any of your products?"

From the comments, I take it most of you took all your arguments for hydrogen from the Top Gear video and you actually believe we get hydrogen as easily as we get gasoline.
