As others say, Congress is the ultimate authority. The FCC and other regulatory bodies only have their regulatory powers because Congress says they do. If an agency makes a regulation and Congress votes to overturn that regulation, it makes perfect sense for that to be the final word.

None of these regulations are “last minute.” They have been working on them for years. It takes a really long time from the start of the process to the finalization. Between the public comment period, judicial reviews, cost analyses, interference from Congress, etc. There are OSHA regulations that were begun way back
