I think its more complicated than that. There are a myriad of reasons why you wouldn't want to file a libel suit against a rape accuser, even if the accusation is false.

but part of Oberst's response was to actually file a suit. Why is it okay in that instance, but Temkin acknowledging that yes he's talked to lawyers (because in cases remotely litigious the most common response is "lawyer up") but he's not going to file a suit is gross and disgusting?

do you have U-Verse or their DSL? They were going to implement data caps a few years ago, and did on DSL, but with U-Verse they never did. They never gave a usage monitoring tool, and from I heard just gave up on the idea for now.
