I am pretty sure the legality is clear. You can take photos of other people in public (consent is not required if just for personal use, sadly that includes extreme personal use, or spank bank).

A very idealistic answer. But the benefit is just not there. I understand dealing with stalkers, they are a focused threat, and I have no issue with shaming or shunning people caught doing the behavior above, and any behavior that crosses over into harassment or stalking is covered by the law.
