I don’t think so - you can appeal a judgment, and the defense can appeal an excessive punishment (such as 25 years for selling food without a permit). But, much like Brock Turner receiving little to no jail time for rape, I haven’t heard of prosecutors appealing a slap-on-the-wrist punishment.

Considering the prosecution asked for years and the judge gave him months, plus the judge’s actions that took place in front of the jury, they may have the ability to appeal. I personally think blatantly violating the terms of a plea deal should be an automatic maximum sentence.
