Stories like this just illustrate the degree to which it's absurd what people can patent. Just because you can word it in a way that's a little different than other people doesn't mean you invented sliding lockscreens or multitouch or black bezels or whatever else one company has claimed another stole.

A phone can pass in a situation where you don't want a device to be blatantly drawing your attention, but a tablet can't.

I don't think this is a big question at all: Author was being an asshole and is trying to make himself feel better by acting like it's some bigger social problem. As said in the piece, a phone would have been passable but having a tablet in that situation is stupid. There's nothing more to it.
