FYI, It’s never been weighted ‘against the GOP’ in my lifetime, they have dominated court nominations since Nixon.   Sometimes Dem-controlled Senates can force them to appoint moderate GOPers, like when Bork was dinged in favor of Kennedy

Mgmt actually had 2 other games in production/pre-production; cutting those earlier would have saved enough cash to finish WD4. But they chose to do no layoffs, go full steam ahead and bet the company on a new VC investment after the WD4 release. They lost.
