But what if the defendant does something so horrifically egregious that it exceeds what a jury wants to award? So not being malicious by awarding an excessive judgment but saying, “this was so awful that we really think this amount will compensate the plaintiffs.”
This suggestion probably wouldn’t go past a judge, but you calculate how much money he made each day he mentioned Sandy Hook or each day someone else mentioned Sandy Hook on his show. That number needs to include the all the sales on the products he shilled on those days too.
