Not really. If someone attempts to run you over but continues to drive away, are you still in danger? You shouldn't be firing at a car driving away.

The act of pointing a gun at someone in the middle of the night and telling them not to move can be interpreted as an attempt to rob them, carjack them or kill them. In which case the players are perfectly justified in trying to escape, even if they almost hit the guy.

If they were in his driveway...I’d have been more sympathetic to what he did, but I still think going immediately to the aggressive way of giving orders or especially brandishing would’ve been a poor way to handle it. He just should’ve gone out there without brandishing and politely asked them what they were doing

I agree with your other points, but I don’t think the kids were trespassing.

I know this is just going to be used as another excuse for people to dogpile on and repeat gun control memes, but even so this guy is flatly in the wrong for apparently going in front of somebody’s car and brandishing on them and giving them orders.

There is no allegation that the players trespassed. Even in the homeowner’s account, they were parked on the street. At which point he pointed his gun at them. The homeowner is entirely in the wrong here, even if the kids tried to run him over (which they had every right to do at that point).

To clarify, even if the two players weren’t technically trespassing, the act of quickly accelerating toward someone can be interpreted as trying to run them over, which would prompt the man to claim he was fearing for his life, giving him the right away again.
