I believe the Declaration of Human Rights and Freedoms to supersede the Constitution in that it was devised for a (more) modern (ie. post World War 2) world, and it in no uncertain terms makes hate speech indefensible as a protected form of free speech.

The ACLU defends the right of everyone to speak publicly, including these assholes, but I am pretty sure they didn’t have that opinion of BLM that you mentioned.
