It’s a cheat because it’s designed to ONLY work on the test bed.

It’s not cheating because they comply with the standards as tested without any special modifications to recognize the test is happening. The problem is the test methodology. Audi is only “cheating” because they added systems specifically to recognize the test and act differently during it.
