Patent attorney here. It would be more accurate to refer to Claim 1 as a “claim” and not part of the “body” of the patent. The claims of a granted patent define the boundaries of the legal right granted by the PTO. The body, also called a description, supports the claims and explains how they work or would work.

IP attorney here. If I were counsel for Blizzard, I would have suggest they do exactly what they did. Specifically, by allowing an unauthorized server with so many users, Blizzard would have left itself vulnerable to trademark dilution and equitable doctrines like waiver and laches.
