I understand your viewpoint, but you first have to understand what you're saying. The top one is modern art, the bottom one isn't. Modern Art isn't a catchall term for artwork things that are current. Modernism relates to a specific movement, style, and/or time period.

Oddworld to me is one of it not the best representation of video games being art. Not only just in the appearance but in the message and story behind the games.

If you took away the jump-packs and the mechs and the free-moving and the bots and the campaign/multiplayer overlap then yes, it'd look like CoD. Funnily enough, most FPS's would look like CoD if you removed the features that distinguish them...
