I took a break from BMWs to try out a 2007 MCS for about 2 years. I could not ~wait~ to dump it. Now I'm back in RWD land where I belong with a Z4. The handling on the MCS cannot compare. Not even close.

False equivalency. This wasn't a drunk driver. This was some person driving the same speed as everyone else who happened to hit an ice patch that others missed, or maybe their tires weren't as good, and wrecked their car into a snowbank. They've got woes already, the state taxing them on top of it isn't necessary.
Nobody was hurt. It's adding insult to injury. I'm pretty sure the driver learned their lesson without the state extracting their pound of flesh for good measure.

Not true. I just replaced the passenger side bulb in my HIDs for $45. If you end up with a bad ballast or igniter, which is not terribly common, maybe $100-150 to have that replaced.
