Last I checked, you supposedly agree to the EULA upon purchase (this is true with a lot of hardware). This is why a lot of resellers have you agree to a EULA upon purchasing specific software and a lot of hardware. I assume that they feel like it's implied. Like I said in my previous comment. Yeah, it's a slippery slope with this one. I don't think that all game companies make you adhere to the "By using the software" clause, but many do include it. What makes it worse is that many don't include the entire EULA in the instruction manual anymore and instead provide you with a link to their website that has

That clause also applies to physical discs. Many companies who sell tech products also have similar clauses stating that you don't own it, simply licensing it.

Most of the instruction manuals include a site for the EULA that you technically agree to by using the software. Here is the one from Rock Star

Technically you dont own your videogame console or game. When you agree to the EULA (which I hope you read) you agree that you dont own the game and are simply licensing it from them. It's a shitty practice overall and their sense of entitlement is getting out of hand.

Sure, theWii U may seem doomed, but its far from out of the game. Throughout their gaming history they have always competed which was superior tech wise and have always finished on top. This is what happens when games are dumbed down to the point where it seems impossible to play without hand holding tutorials at every turn. What ever happened to devs coming up with creative alternatives to teaching its audience how to use their power ups and the like?

A lot of it is plausible, but particle physic styled lighting like in the scuba diving shots have failed on consoles and I doubt the hardware can handle it.

I doubt that Wii U will get games from Take Two or EA. These companies are trying to protect their pockets seeing as how there's a possibility of these summer titles not being picked up, and the minimal interest in next gen consoles.

Your stock photo analogy is wrong. These photographers pay for a copyright that would make it illegal to download or print their photos without purchasing the right to do so. They put a lot of work into those photos and its within their right to charge what they want for them, as for game companies, I dont necessarily
