The driver has indeed negotiated the rate. They have agreed to that rate when they CHOOSE to drive for Uber or Lyft. The driver could have also chosen not to accept that rate and went with another ride share service, or not accepted to drive at all. And if you choose not to decide, you still have made a choice.
