Well, no, they can't rule on the matter unless a case is brought before them that specifically challenges the 435 cap. From what I can find on the Googs, there hasn't been an apportionment case since 1992 and it wasn't about the cap itself.

It's not Wyoming's fault, you can't get a fractional person to represent you in Congress.* The problem is with the Reapportionment Act of 1929 capping the number of Congresspeople at 435, making it near-impossible to ever get mathematically correct apportionment based on census data.

Our chance to prevent them from running things in Congress comes but once a decade, as it's gerrymandering that has made Congress what it is today. So we have to get off our asses to demand fair districting in our individual states so that we're prepared for the next census when districts get redrawn.
