I always love when someone screams “THAT WAS OUT OF CONTEXT” and then when they provide the context it doesn’t actually help the statement in question even a tiny little bit.

And as such, that’s exactly the kind of case that class-actions are best-suited for: one where any given individual harm is so small that the company figures no one is going to feel it’s worth complaining about their deceptive actions.  A big part of the point of class-actions is to be punitive in order to dissuade…

I guess my point is: neither is slamming on the brakes every time a car is at, approaching, or even still moving at a crossroad.

I guess that’s what I get for responding to “just to start an argument,” isn’t it.  In any event, I used “presume” rather than “assume” purposefully for that exact reason.

I think there’s a much simpler explanation: the truck driver reasonably presumed that the car was about to pause/stop in the median until the way was clear.
