Thanks for spelling out that you can use Google Authenticator for Microsoft’s 2FA, I only discovered that recently, and it’s handy.

@bluebears: well, to be fair, i don't have a ton of experience - just your basic evidence class. but we learned that the standard to admit this kind of evidence under the "modus operandi" exception was much higher than what you're describing - tons of people crawl through windows to rob. for an MO exception, you have

@bluebears: A defendant's criminal history never comes up in court unless a. the defendant testifies, or b. one of his character witnesses testifies that the defendant has a character for truthfulness or nonviolence (and they have a conviction that belies that assertion). It can only be used to impeach, it cannot be

@grace ipsa loquitur: I disagree. There just needs to be some element of repeating a pattern. How did he break in previously? Did he crawl through a window? If yes, then it should've come in.

@bluebears: it's the rules of evidence, (s)he didn't have a choice. it likely wouldn't have been admissible even if it was the exact same crime, since breaking and entering is such a generic crime that so many people do. it's actually a really legitimate rule (show someone evidence that the person has committed this

I can't believe the judge wouldn't let the burglary conviction in if the rape involved breaking and entering. You can let evidence in if it's probative value outweighs it's prejudicial effect. Every fucking 2nd year law student knows that.
