Both Icon and Rocket are properties of Milestone and for the time being can’t be used by D.C. They’re rights reverted back to the original owners.

It’s already happening for the past half decade.

There’s a lot of assuming going on when we don’t know what either Mr.Oz (who may or may not be Ozymadias) or Manhattan. And John’s already said that it won’t be a simple good vs evil story.

If I’m being honest here, I think DC knows this just as much as we do. They know a gimmick like the Death of Hawkman would have no impact, so they just hope to make a great mini-series.
