If he's sent it in an envelope with a warning on the envelope in more than 8 point font warning that the material was obscene, then that would not have been obscenity.
I wouldn't blame the defendent lawyer so much as the fact that the prosecution brought a borked case on legislation that would have required a radical statutory interpretation (which most judges are unwilling to do, unless you have an American Denning out there)

I was more entertaining the hypothetical possibility of whether after a rape case, one should be allowed to bring a libel suit against an accuser if they have made that claim fraudulently, rather than engaging with the circumstances of the article

The problem being that wouldn't apply in situations where libel is being contested. Allowing an anonymity order for the claimant in that situation is shutting the stable doors after the horse has bolted

I think a careful distinction would have to be drawn between rape allegations that turned out to be fraudulent (and could plainly be proved to be so) compared to rape allegations that fail either due to a lack of evidence or because it can't be proved beyond reasonable proof
