What would happen is that someone would challenge the family over being able to decide for the fetus, file a lawsuit asking the court to appoint a guardian ad litem for the fetus, and then arguing that the law says that the fetus must be protected, blah etc.

Just FWIW, I am a medical ethicist, and I know my colleagues. And I was very particular in my phrasing about the broad pronouncements and people commenting on the case in question for a reason.
