I usually slow down to 15-25mph in order to pass someone going that slow on the side of the road. Here, it seems like the driver was driving at normal speed around the truck when the truck initiated the U-turn and was hit. Correct me if I'm wrong and the truck actually hit the VW mid-pass.

You could just as easily say that the driver was criminally stupid for not slowing to a crawl or stopping upon seeing a disabled vehicle sitting in the road.
