Well, at least in the case of cell phone use it’s quite easy to prove distraction. Just subpoena the phone records of the driver that’s suspected of driving distracted.

A couple of years ago I went to get on the PA Turnpike at the Monroeville entrance and couldn’t believe the oily scum all over that pavement at the toll booths. Was quite concerned I’d slip and drop my bike on that shit.
