Well most Japanese RPGs aren't expected to come to the US. XSEED is a company that licenses japanese games and then translates them and brings them to the US. Isn't the delay for these games usually due to how long they take to translate and the English versions usually not being worked on until the Japanese version has been completed? And for Europe they have to be translated to all the major languages of the EU before being released. Not because of region-exclusivity.

The contracts (at least in the US) only say that early selling of the games may result in being denied future shipments. They aren't legally binding to include any kind of financial repercussions or any fines or anything.
