I agree the air was shitty, but I'd argue that if the Govt Court system worked in the manner that it was told it would work, people like you and I could easily argue that the smog situation, brought about by vehicles and other pollution producing machines were violating your right to breath good air.
Well that is my point, much of the weight was mandated. Airbags are useful when you're in an accident, no doubt - but shouldn't an airbag be a choice or any other safety device?

You're correct, but what is forgotten is who was there to protect that land from getting dumped on? Was it a private owner, or was it public land controlled by the same Govt that didn't give a sh*t and most likely at some point were told to turn away by a fat lobbyist?

The market (customers in this case) were stripped of their ability to rightfully make that arguments in the courts and make companies financially responsible to change their business practices.
