I don't think there should be any special exceptions made for Tesla just because it's unique. If you're going to do it, do it for everyone not just Tesla!

Your private event? so you own the track and are the only person out there driving? if not then it is a public event unless the OWNERs of the track say otherwise, if the owners or managers don't mind that photographer being there then your only option is not to show up.
