It’s a scale. Generally there’s a recognition that kid’s brains are developing, and it’s generally a scale about when and whether this person did develop enough to be cognizant than action was wrong and thus could be held culpable.

If he doesn’t go (i.e. the guy driving around the group of paying customers) it means they don’t get any paying customers at all.

2 out of 26 means 1 out of every 13 people. That’s pretty much standard designated driver levels (maybe even less, probably should be more like 1 in 4. That’s just a part of the cost of doing business.
